GENERAL CONDITIONS OF SALE
Premise:
This General Conditions of Sale document (hereinafter: GCS) regulates the Purchase Agreement (hereinafter: the Contract) of the products offered and marketed by SAN BIAGIO IMPORT EXPORT di FARACI DANIELA (hereinafter: the Seller), based in MILITELLO ROSMARINO-ME-P.ZZA G.LODATO, 7-98070 - VAT number: 03309450835- REA registration number: ME 228217, through its website WWW.CIALDACONVENIENZA.IT (hereinafter: the Site).
The legislation to which these GCS refer is identified with Legislative Decree 6 September 2005, n. 206 - Consumer Code - and subsequent amendments.
All the Contracts and the relative phases of proposal, order and order confirmation for the purchase of products, offered on the Site to customers identifiable as "consumers", are governed by this document.
Pursuant to art. 3, co. 1, lett. a of the aforementioned Decree, is qualified as a "consumer" "the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out".
The information provided on the Site is in Italian. By completing the order, the customer declares to have previously read and accepted these GCS and the Privacy Policy by clicking on the "Accept" button.
The GCS applicable to the order are those published and in force on the date of the order.
Products:
The Site mainly sells coffee in pods / capsules or other types of related products whose characteristics and units of measurement are described from time to time.
The information on the product descriptions are provided for illustrative purposes.
In the presentation of each individual product on the Site, in addition to the type or name with which it is commonly understood, any other useful information is provided. Photographic images made as accurately as possible are also provided. Despite this foresight, there may be a deviation in the correspondence between the images displayed on the Site and the existing product.
Prices:
The prices indicated are in Euros and include VAT and any other taxes. .
Shipping costs are excluded and are displayed in the cart and in the order summary. In the case of shipments on the Italian territory (ITALIAN SHIPPING mode) they are calculated by decreasing, as the order amount increases, up to € 0.00 when a certain threshold is exceeded in this way:
Shipping cost € 4.90 for orders below € 99.90
Shipping cost € 0.00 per order over € 99.90
The price for each individual product, applied and guaranteed to the customer, is that indicated on the site at the time the order is sent.
Orders:
The purchase order for the products in the cart provides for the insertion of the necessary information, the acceptance of these Conditions and the Privacy Policy. The customer expresses the will and the awareness to submit a binding order proposal with the obligation to pay in advance by clicking on the button which, depending on the payment method chosen, may bear the words: "ORDER" or "PAY NOW".
The payment methods provided are:
· Advance bank transfer;
Credit card (Paypal platform);
The order proposal must be complete in all its parts. Any mistakes or errors in the delivery of the products, due to incomplete or incorrect entry of the requested data, cannot be attributed to the seller.
To confirm receipt of the order, the customer will receive a confirmation e-mail after a short time with a summary of the products purchased, payment methods and shipping times.
In the case of orders with payment methods by bank transfer, the products will be shipped only upon notification of payment. The advance bank transfer must be made within 4 working days (Mon - Fri) from receipt of the e-mail containing the IBAN. Once this deadline has passed unsuccessfully, the order will be deemed void.
The availability of the products marketed on the site is constantly updated however, both for the possibility of multiple orders for the same item and for the simultaneous sale at the physical store, there may be a sudden lack of some products.
The Seller undertakes to promptly notify the customer if, for reasons of sudden unavailability of one or more items or for any other problem concerning the order, he is forced to cancel all or part of the shipment of the products.
In the event of total cancellation of the order, the entire import will be re-credited to the card or Pay Pal account used by the customer or by another method agreed with the same.
